smoolie671 Posted June 16, 2007 Posted June 16, 2007 Well I hate to have to admit this but I seriously doubt Morningstar will see the water this year. Last Thursday I was in a serious motorcycle accident. Some guy wasn't watching and made a left-hand turn in front of me. I locked the brakes on the bike and tried to come to a stop before hitting him. I lost control and the bike went down hard and dragged me. In the process my left arm was pulled underneath and behind me causing my back to be twisted beyond the breaking point. I broke two ribs between my shoulder blades about 2 to 3 inches from the spine. I also got bad road rash on various parts of my body. Since I'm not sure I made contact with the other drivers car, my insurance rep is saying that it's possible that his insurance won't pay for anything even though he violated traffic laws and caused the accident. I'm at a loss and don't know what to do. Quote

Take advantage of the free consultation they give you so you can mention that if the other guy's insurance says "nyet". It all depends on the state and the individual circumstances, (Disclaimer: I generally hate attorneys, but I also generally hate insurance companies after dealing with them in my last job for 10 years.) The other guy's insurance may fight you ... they take any opportunity to cheat people out of money, IMNSHO ... but if he caused the accident by his actions, your insurance can probably still go after him (or you can personally, by suing him). But Andrew's right ... its good that you are still with us. Here's to a speedy recovery without too much pain from the ribs (ouch!). Quote

If it is any consolation, that was what put me on the road from my bike in the only serious accident I had on motorcycles. In my case, I did contact the quarter panel of the car in question with a glancing blow, wobbled a bit, then laid it over on its side and my wife (then fiance) and I slid down the road for what seemed like forever. We were dinged up pretty bad, but no life-threatening injuries. We were sure glad we were wearing helmets, as there were several DEEP scratches on both of them. We had a bit of an insurance fight, but the other guy's insurance did pick up the medical and the damage to the bike (we were in Hawaii). Sounds like you have a fight on your hands, but I think a good lawyer (is that an oxymoron?) will be able to make this one pay for you. Good luck and get well enough to finish the "Morningstar." PAR Posted June 17, 2007 Posted June 17, 2007 A current client of mine, who found me on this forum, is an attorney and has made my rather poor opinion of them (generally) swing upward again. My previous opinion was they were pretty much like septic tank workers, you didn't want to know them, unless your tank was over flowing and you were swimming in chunks. I've found him to be honest, reliable and handy to know, we've become friends. We need people like him, to get in there and fight for us in a system, intentional designed to be confusing. They can sort out the crap and cut to the real heart of the matter. This is what you need Smoolie. Someone who will make the insurance company realize that as a result of the actions of their policy holder, you now have serious injuries, medical expenses and legal fees, which you wouldn't have had, if their policy holder hadn't been a bonehead. Sick the "pit bulls" on them, this is what they live for, much like we, with a fine breeze and a good ship. Don't take no for an answer, mistakes happen, that's why we have insurance . . . go get their ass. (and get well soon too) Quote

I have been through a claim that had to go to court and once you see the truth about the insurance you realize the agent is there to be your "freind" and make you feel good about the company. He is the just a salesman. Once there is a claim, he is out of the loop, it's all in the hands of the higher ups. He is there to be smile and collect your money. He no NO authority at all! Quote
Charlie Jones Posted February 28, 2012 Posted February 28, 2012 Now I don't know about that. We were in a wreck some years ago that totaled two boats on our trailer. Guy ran a stop sign and t-boned us right in the rear bumper . We had the same insurance company as the other guy and due to his lying, had some trouble. Called my agent, he picked up the phone, screamed a bit and we got compensated for truck damage, trailer totaled and paid for both boats, thanks to our agent. So SOME of them care Quote
